Welcome to the terms and conditions (“Terms”) for 8Pass. These Terms are between you and Poncho Hospitality Private Limited (“BOX8”) and/or its affiliates (“BOX8” or “Us”) and govern our respective rights and obligations. Please note that your use of the BOX8 website/App and subscription to 8PASS are also governed by the agreements listed and linked to below, as well as all other applicable terms, conditions, limitations, and requirements on the BOX8 website, all of which (as changed over time) are incorporated into these Terms. If you sign up for 8Pass, you accept these terms, conditions, limitations and requirements.

Promotional Trial Memberships
We sometimes offer certain customers trial or other promotional notices, which are subject to these Terms except as otherwise stated in the promotional offers. BOX8 will notify members at the end of the promotional period and on its expiration, customers will get the option to make a purchase of the 8Pass membership and continue their 8Pass benefits.
The annual membership, if applicable will be stated in the 8Pass detail page of the app. From time to time, we may offer different membership terms, and the fees for such membership may vary. The 8Pass membership fee is non-refundable except as expressly set forth in these Terms. Taxes may apply on either or both of the fee and the reduced shipping charges for 8Pass. By signing-up for 8Pass, you confirm that you are a resident of India. You cannot use a credit or debit card issued outside India to pay for the membership fee for 8Pass. You cannot pay for 8Pass using COD/Cash on Delivery. 8Pass payment only becomes effective upon successful authorization of payment made through the BOX8 website.
Delivery Benefits and Eligible Purchases for 8Pass
8Pass delivery benefits depends upon inventory availability, order deadlines, and the delivery address. They are limited to certain products sold on the BOX8 app/web. Products eligible for 8Pass will be designated as such on their product pages. Some special product, order, handling fees, and/or taxes may still apply to eligible purchases. We may also exclude products with special shipping characteristics at our discretion.
Other Benefits / Other Limitations
- We reserve the right to accept or refuse membership in our discretion.
- We may send you email and other communications related to 8Pass (regardless of any settings or preferences related to your BOX8 account).
- You may not transfer or assign your 8Pass or any 8Pass benefits, except as allowed in these Terms.
- 8Pass holders are not permitted to purchase products for the purpose of resale, rental, or to ship to their customers or potential customers using 8Pass benefits.
- From time to time, BOX8 may choose in its sole discretion to add or remove 8Pass benefits.
Your 8Pass will be activated only on successful payment for 8Pass made through the BOX8 website/app.
You can cancel your 8Pass membership by writing to firstname.lastname@example.org. Refund will be based on usage of the plan, discounts redeemed and the days remaining of the payment. If you cancel the pass before the paid period starts, we will refund you the entire amount back. If you cancel the pass without using it for any discounts within 5 days of subscribing, We will refund the entire amount back to you.
If you have purchased 8Pass along with some other items, you can cancel it and get the entire amount back only if you haven’t got any discounts using it.
If you have got discounts applied to the order then we will deduct the discount amount from the 8Pass charges and refund the remaining amount back.
We may in our discretion change these Terms, BOX8’s Conditions of Use, Conditions of Sale and Privacy Notice, or any aspect of 8Pass, without notice to you. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED USAGE AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST REQUEST TO CANCEL YOUR 8PASS.
Termination by Us
We may terminate your 8Pass at our discretion without notice. If we do so, we will issue a credit note to you and give you a prorated refund based on the number of full days remaining in your subscription. However, we will not give any refund for termination related to conduct that we determine, in our discretion, violates these Terms or any applicable law, involves fraud or misuse of the 8Pass, or is harmful to our interests or another user. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.
Limitation of Liability
IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN BOX8’S CONDITIONS OF USE AND SALE , IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO 8PASS. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE AMOUNT YOU PAID. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR 8PASS.
